Updated Terms and Conditions for the Lollipop Collective
Effective Date: 05/06/2025
These Terms and Conditions apply when you use our website, https://www.lollipopcollective.com.au, subscribe to our communications, apply to join Lollipop Collective, or take part in our pop-up stores, markets and events. Our handling of personal information is explained in our Privacy Policy.
1. Vendor Participation
-
Lollipop Collective is a shared retail environment for independent small businesses. Vendors operate as independent businesses. Nothing on this website or in these terms creates an employment, partnership or agency relationship.
-
By applying to join the Collective or an event, you agree to provide accurate and current business information.
-
Approval of applications, store locations, allocations and products is at the sole discretion of Lollipop Collective.
-
Vendors must comply with all applicable laws, health and safety requirements, and the rules of each shopping centre or venue.
-
Once approved, your participation is governed by a written Lease Agreement. Its fees, payment terms, commission, rostering, notice and termination provisions apply to you. If these terms and your Lease Agreement are inconsistent, the Lease Agreement prevails.
2. Products
-
Vendors must ensure all products comply with Australian laws and safety standards, do not infringe anyone’s intellectual property, and are not counterfeit or unauthorised reproductions.
-
Products must be approved before display. Lollipop Collective may remove any product that does not meet these requirements.
3. Fees, Payments and Sales
Fees, rent, commissions, merchant processing fees and payment deadlines are set out in your Lease Agreement and communicated by invoice. Vendors must pay amounts due by the stated deadlines.
4. Cancellations and Notice
Vendors on ongoing six-week blocks must give at least three (3) weeks’ written notice before the end of their current block, in the manner set out in their Lease Agreement. Seasonal trading periods (such as Christmas) have separate terms set out in the relevant schedule. Notice is only valid if given as the Lease Agreement requires.
5. Event and Store Changes
Lollipop Collective may modify, relocate, suspend or cancel any event, pop-up or trading period because of weather, safety, centre requirements or other circumstances outside its control.
6. Insurance and Risk
-
Vendors must hold appropriate product and public liability insurance where applicable.
-
Lollipop Collective’s insurance does not cover vendors’ products or stock.
-
Lollipop Collective is not responsible for loss, theft or damage to vendor stock or property.
-
Vendors take part at their own risk.
7. No Guarantee of Sales
Lollipop Collective does not guarantee sales, customer traffic or business outcomes.
8. Conduct and Reputation
Vendors must behave professionally and must not make false, misleading or damaging statements about Lollipop Collective, its staff or other vendors. Lollipop Collective may suspend or end participation where these terms or the Lease Agreement are breached.
9. Confidentiality
Business and sales information shared within the Collective is confidential and must not be disclosed to third parties.
10. Communications
By subscribing or providing your contact details, you consent to receive updates and promotional communications from Lollipop Collective. You can unsubscribe at any time using the link in our emails.
11. Intellectual Property
-
All content on this website, including logos, text, images and event materials, is the property of Lollipop Collective unless otherwise stated.
-
You may not copy, reproduce or distribute our content without written permission.

You agree not to use this website for any unlawful purpose. We may suspend or restrict access to our website or services for breaches of these terms.
13. Liability
To the maximum extent permitted by law, Lollipop Collective is not liable for any loss of income, profit or business opportunity, and is not liable for events outside its reasonable control. Nothing in these terms excludes or limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
